1. Definitions

In these Terms & Conditions, the following definitions apply:

• Forever Wedding: the trade name under which the service is offered, operated by Alwend werkt B.V.
• User: any natural or legal person who makes use of Forever Wedding's services.
• Service: the online platform by Forever Wedding through which guests can upload photos via a QR code at a wedding or event, and the registered user can manage and share those photos.
• Subscription: the agreement by which the User gains access to the (extended) features of the Service in exchange for payment.
• Guest: a visitor who uploads photos via an event's QR code without having an account.

2. Applicability

These Terms & Conditions apply to all offers, agreements, and services of Forever Wedding. By using the Service, the User accepts these terms.

Deviations from these terms are only valid if agreed in writing with Forever Wedding.

3. Offer and agreement

All offers by Forever Wedding are non-binding and may be revoked at any time. An agreement is formed when the User registers and accepts the applicable terms.

Forever Wedding reserves the right to refuse a registration without stating reasons.

4. Subscriptions and pricing

4.1 Subscription types

Forever Wedding offers the following subscription types:

• Free: limited functionality, suitable for small events.
• Basic (Personal): extended features including download options and slideshow.
• Premium (Personal): all features including highlight film and priority support.
• Business: multiple events, brand customisation, and business reporting.

4.2 Price changes

Forever Wedding reserves the right to change prices. Price changes will be communicated at least 30 days in advance. In the event of a price increase, the User has the right to cancel the subscription before the new price takes effect.

5. Payment

Payments are processed via the offered payment methods, including Stripe. Payments are billed in advance for the applicable subscription period.

In the event of late payment, Forever Wedding is entitled to (temporarily) suspend access to the Service.

Subscriptions renew automatically unless the User cancels before the end of the current period via the subscription settings.

6. Use of the service

6.1 Permitted use

The Service may only be used for lawful purposes and in accordance with these terms. It is prohibited to:

• Upload content that infringes the intellectual property rights of third parties;
• Post unlawful, offensive, discriminatory, or sexually explicit content;
• Use the Service for spam or commercial purposes without permission;
• Circumvent or damage the technical security of the Service;
• Upload more than the permitted number of photos per event.

6.2 Guest content

The User is responsible for content uploaded by guests through their event. Forever Wedding enforces a maximum file size of 25 MB per photo and does not accept executable files or videos.

7. Intellectual property

Photos uploaded by guests remain the property of the respective photographers (the guests). By uploading, the guest grants Forever Wedding a limited licence to store, display, and make the photos available to the relevant User.

Forever Wedding claims no ownership rights over content uploaded by Users or guests. The User warrants that uploading content does not infringe any third-party rights.

The platform itself, including the software, design, and branding of Forever Wedding, is and remains the exclusive property of Alwend werkt B.V.

8. Privacy and data processing

Forever Wedding processes personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR). For more information, please refer to our Privacy Policy.

9. Liability

9.1 Service obligations on paid plans

Forever Wedding will make every reasonable effort to fulfil the storage and access periods stated for each paid subscription plan (Basic: 1 year; Premium: 1 years including backup). These obligations are fulfilled on a best-effort basis. Forever Wedding cannot guarantee uninterrupted availability at all times and is not liable for temporary outages.

9.2 Limitation of liability

To the maximum extent permitted by applicable law, Forever Wedding's total liability to a User for any loss or damage, including loss of photos, is limited to the total amount paid by that User to Forever Wedding for the relevant subscription in the twelve months preceding the event giving rise to the claim.

For Users on the free plan, Forever Wedding provides the service on an "as-is" basis without any warranty of availability or data retention, and no liability is accepted for loss of data.

9.3 Exclusion of indirect and consequential damages

Under no circumstances is Forever Wedding liable for:

• Indirect, incidental, or consequential losses;
• Loss of sentimental or emotional value (including irreplaceable wedding memories);
• Loss of revenue, business opportunity, or reputation;
• Unlawful or inappropriate content posted by guests or third parties;
• Actions by third parties who have gained unauthorised access to a User's account.

9.4 Force majeure

Forever Wedding is not liable for any failure to fulfil its obligations caused by circumstances beyond its reasonable control, including but not limited to: failures by third-party hosting providers, power outages, natural disasters, cyberattacks, or changes in applicable law.

10. Suspension and termination

Forever Wedding may suspend access to the Service or terminate the agreement if:

• The User violates these terms;
• There is evidence of fraudulent use;
• There are indications of misuse of the Service.

Upon termination of the subscription, uploaded photos will be deleted after 90 days unless the User has downloaded them beforehand.

11. Amendments

Forever Wedding reserves the right to amend these Terms & Conditions. Registered Users will be notified by email of material changes. Continued use of the Service after the effective date of the changes constitutes acceptance of the amended terms.

12. Governing law

These Terms & Conditions and all agreements with Forever Wedding are exclusively governed by Dutch law. Disputes will be submitted to the competent court in the district where Alwend werkt B.V. is established.
